RELEASE OF LIABILITY FOR MINOR PARTICIPANTS

PART 1

IN CONSIDERATION OF myself, or my child(ren)/ward(s) being allowed to participate in any way with Superior Self LLC also represented and known as "Superior Fitness" related events and activities, the checked box below acknowledges, appreciates, and agrees that:

​

The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to myself or my  child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

​

1. FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my own participation and or my child’s participation; and,

2. I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my or my child’s readiness for participation and/or in the program itself, I will remove myself or my child from the participation and bring such attention of the nearest official immediately; and,

3. I myself, my spouse, my child, and on behalf of my/our selves and our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Superior Self LLC also represented and known as Superior Fitness; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, coaches and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to myself or my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

4. I, for myself, my spouse, my child, and on behalf of my/our selves and our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

5. I, the parent/guardian/myself, assert that I personally understand and or have explained to my child/ward: the risks of the activity, my/his/her responsibilities for adhering to the rules and regulations, and that I or my child/ward understands this agreement.

6. I, the parent/guardian/myself, assert that I am in agreement with the taking of any pictures or video of my self or my child(ren)/ward(s) and assert that I am in agreement with the use of those pictures and/or video to be placed on social media, placed on flyers or use for any other promotional uses as Superior Self LLC also represented and known as "Superior Fitness" should decide.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

PART 2

Video/photo release and social media consent

I hereby grant Superior Self LLC, its representatives and employees, permission to use and/or publish photographs and/or videos of myself, my children or anyone else that I’m the guardian of in print and/or electronically. I understand and agree that these materials will become the property of Superior Self LLC and will not be returned. I hereby authorize Superior Self LLC to edit, alter, copy, exhibit, publish, or distribute the photograph(s) and/or video(s) for purposes of publicizing their programs or for any other lawful purpose.In addition, I waive my rights to any compensation arising or related to the use of the photographs and/or videos.I release and discharge Superior Self LLC from any and all claims arising out of use of the photos and/or videos for any lawful purpose such as for publicity, illustration, advertising, and Web content.

Additionally, I grant Superior Self LLC, and its agents and employees, the irrevocable and unrestricted right to reproduce the photographs and/or video images taken of me, or members of my family, for the use of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. I hereby release A+ World Academy and its legal representatives for all claims and liability relating to said images or video. Furthermore, I grant permission to use my statements that were given during discussion, interview or other communication, with or without my name, for the purpose of advertising and publicity without restriction. I waive my right to any compensation.

 

In the case of minors, Superior Self LLC has my permission to use photo(s) and/or video(s) of my child or legal custody with all the permissions outlined above. I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee or other compensation shall become payable to me by reason of such use. Student's
